This is an explanation of the terms and conditions governing the use of the BackMe.org website to earn payments from Calvary Fundraising LLC (us, we) for any charity, individual, entity for profit, entity not for profit or for any other reason. Please read this agreement carefully before registering as a recipient of payment or before shopping with the merchants linked from this website.
You must provide us with requested information in order to receive payment and it is your responsibility to keep this information current. Every attempt to reach you using the supplied information will be made, however payment returned due to outdated contact information will be forfeited after a period of one year.
How Earnings/Donations Accrue
Merchants pay commission amounts to Calvary Fundraising LLC (dba BackMe.org) for sending customers to their websites when that customer makes a qualifying purchase. Calvary Fundraising LLC makes a contribution to you based on commission amounts received from the merchants. Contribution amounts are listed next to merchant links and are subject to change or vary without notice. Some purchases from merchants are not considered commissionable and will not receive contributions.
Eligibility
You must be an individual, 18 years of age or older to register. If you register for or on behalf of another person or as an authorized representative for any charity, group or entity, you certify that you have the authority to do so.
You must provide us with a current email address and a current telephone number. It is your responsibility to direct your email software to receive email from backme.org@calvaryfundraising.com.
Accrual and Schedule of Payments
Earnings are accrued when you and/or anyone else links to a merchant from your account page on the BackMe.org website. Earnings are credited when a qualified purchase is completed with an affiliated merchant based on agreement between Calvary Fundraising LLC and merchant. Estimated earnings per qualified transaction are posted on the category pages next to the merchant links and ARE SUBJECT TO CHANGE WITHOUT NOTICE. In every situation, the commission actually paid from the merchant to Calvary Fundraising LLC will be used to compute the amount of earnings you accrue.
As a general rule, earnings are computed on the net amount of the purchase not including tax, shipping, discounts, coupons, returns and cancellations, fees and similar charges imposed by the merchant. In some cases, no earnings will be accumulated if gift cards are used to pay for the purchases. In some cases, you will accumulate earnings when purchasing gift cards. Specific terms and conditions vary from merchant to merchant.
IN NO CASE WILL EARNINGS ACCRUE IF YOU LINK TO THE MERCHANT FROM ANOTHER WEBSITE OR IF YOU HAVE INSTALLED SOFTWARE THAT PLACES AN AUTOMATIC "SHOPPING CODE" ON LINKS TO MERCHANTS! IT IS YOUR RESPONSIBILITY TO INSURE THAT YOU DO NOT HAVE SUCH SOFTWARE INSTALLED ON YOUR COMPUTER.
IMPORTANT:
SOME MERCHANTS REQUIRE THAT YOUR "SHOPPING CART" OR "SHOPPING BAG" BE EMPTY WHEN YOU LINK TO THEIR WEBSITE IN ORDER FOR COMMISSIONS TO BE PAYABLE EVEN IF YOU EMPTY YOUR CART OR BAG WHEN YOU ENTER THEIR WEBSITE BEFORE SHOPPING.
In order for purchases to be properly tracked, "cookies" must be enabled on your web browser. Purchases must be made during the same shopping session where you linked from the BackMe.org website. Purchases made during subsequent visits without first linking through BackMe.org with an empty cart may or may not result in earnings accrual.
The determination of a qualified purchase will be made at the sole discretion of the merchant. Subsequent returns of merchandise or cancellation of services may result in reduction or elimination of earnings. If unpaid earnings are not adequate to allow reduction in earnings, reduction will be taken from future earnings.
If you make a purchase or agreement for services that no corresponding earning is posted, you may submit the information to us at contactus@calvaryfundraising.com within 90 days of the transaction date. We will make every attempt to resolve the issue with the merchant. Earning agreements are between you and Calvary Fundraising LLC, therefore you should not contact the merchant regarding earnings accrued through use of the BackMe.org website.
Earnings received from Calvary Fundraising, LLC may be considered taxable by the Internal Revenue Service or other authorities. If your earnings in a calender year reach an amount where we will be required by the IRS to issue an earnings statement, YOU MUST PROVIDE US WITH A VALID SOCIAL SECURITY NUMBER before that threshhold payment is issued. Calvary Fundraising LLC makes no representation about the tax liability of payments made to registrants from us. We recommend that you seek advise from a competent tax adviser.
Calvary Fundraising LLC is supplied with merchant links via merchant representatives and therefore does not guarantee the validity of the link or guarantee any offers or representations made on the face of the link. Once you have connected to a merchant website, Calvary Fundraising LLC is not longer responsible for the content or transaction conducted with the merchant.
Payment Schedule
Calvary Fundraising LLC issues earnings and/or contribution checks quarterly to accounts whose current payable balance is $25.00 or greater. To allow for returns, earnings are not considered payable until the commission payments have been received from the merchant by us. Balances less than $25.00 will carry forward to the next payment cycle. Payments will be made on or about March 15, June 15, September 15 and December 15 to eligible accounts.
Communication with Accounts
By registering with Calvary Fundraising LLC to earn payments, you agree to receive communications that are account related (e.g., that we've added earnings to your account, that we are mailing you a check on a certain date) as well as occasional shopping related information (e.g. coupons, free shipping offers, earnings tips).
Calvary Fundraising LLC does not warrant, guarantee, or make any representations regarding the quality of, or accuracy of advertisements for, any merchandise, products, or services offered or provided by affiliated stores or suppliers in conjunction with the program. We do not warrant, guarantee or make any representations that this site is free of destructive materials or viruses. In addition, we do not warrant that access to this site will be uninterrupted or error-free, and we assume no responsibility for any damage caused by your access, or inability to access this site or your use, including, but not limited to, your inability to accrue cash back rewards by purchasing items with an affiliated store.
Limitation Of Liability
In no event will any other company with which Calvary Fundraising LLC has an affiliate agreement or other relationship including without limitation, co-branding, co-marketing, joint development, a store relationship, or a licensing or supplier relationship be liable to you for non-performance of Calvary Fundraising LLC obligations. You agree not to sue any participant for non-performance by us. In no event shall we be liable for any damages, claims or losses incurred (including without limitation compensatory, incidental, indirect, special, consequential, or exemplary damages), however caused and under any theory of liability arising in connection with: (i) the program; (ii) any failure, delay, or decision by us in administering the program; (iii) the use or inability to use this web site; including but not limited to lost profits, lost business or lost opportunity, or any indirect, special, incidental or consequential or exemplary or punitive damages, including legal fees, arising out of such use or inability to use the website, or (iv) the purchase or use of any merchandise, products, or services of stores or suppliers, even if Calvary Fundraising LLC, or representatives thereof, are advised of the possibility of such damages, claims, or losses and notwithstanding any failure of essential purpose of any limited remedy.
Registrant agrees to indemnify and hold Calvary Fundraising LLC, its subsidiaries, affiliates, officers, directors and employees, harmless from any claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of member's use of the program, the violation of these policies by member, or the infringement by member, or other user of the program, of any intellectual property or other right of any person or entity, or as a result of any threatening, libelous, obscene, harassing or offensive material contained in any member communications.
Termination Or Changes To The Program
Calvary Fundraising LLC reserves the right to terminate the program at any time with notice. Notification of program termination will be sent to the email address you provide to us during the registration process or the most most current email address you have provided to us. We will not be responsible for failing to notify you of program termination where such failure is caused by any reason outside the control of Calvary Fundraising LLC, including an error in your email program, an inaccurate email address, your failure to check for your email online, or your failure to inform us of a change in your email address.
Termination Of Participation
Participation in the program is subject to these Terms and Conditions. Any failure to comply with the Terms and Conditions, any fraud or abuse relating to the accrual of earnings, or any misrepresentation of any information furnished to us or our affiliates by you, or anyone acting on your behalf, may result in the termination of your participation privilieges in our program, ancellation of your Ebates account and/or forfeiture of your accrued earnings. We also reserves the right to close accounts that have been inactive for more than 12 months. Inactivity is defined as no accrual of earnings or tracked usage of our affiliate links. Any accrued funds over the amount of $5.00 will be disbursed in full to participant. Accrued funds less than $5.00 will be forfeited.
MISCELLANEOUS
This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without reference to conflicts of law rules. As a condition of the use of the BackMe.org website, you agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Cherokee, Geogia and therefore agree to file any grievance or suit of any kind exclusively in the courts located within the county of Cherokee, Georgia. If any provision of this agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the other provisions contained herein will remain in full force and effect. Our failure to insist upon or enforce strict performance of any provision of the Agreement shall not be construed as a waiver of any provision or right. Nothing in this Agreement shall be construed as creating or constituting a partnership, joint venture or agency relationship between Calvary Fundraising LLC and the affiliated merchants. The affiliated merchants nor any any other entity shall have the ability to create any obligation on Calvary Fundraising LLC's behalf. This agreement constitutes the entire agreement between you and CalvaryFundraising LCC.
